Terms and Conditions
In these terms of use:
- 'ACARA' means the Australian Curriculum, Assessment and Reporting Authority;
- 'Item Authoring Tool' is the item authoring tool available on http://item.noac.edu.au that is visible through use of a web browser;
- 'Password' means the password and/or personal identification number provided to you by ACARA for the sole purpose of accessing the Item Authoring Tool;
- 'Test Items' means test items created by You for ACARA;
- 'Website' is the website accessed through http://item.noac.edu.au that You are currently using, but does not include websites to which this website has links (if any);
- 'You' are an authorised user of the Item Authoring Tool.
These terms of use:
- apply only to your use of the Item Authoring Tool;
- do not apply to the Test Items. (Note, with regards to Test Items, that ACARA’s contractual arrangements apply to ACARA employees and contractors, and stipulate confidentiality and intellectual property requirements).
Your use of the Item Authoring Tool hosted on http://item.noac.edu.au is subject to the terms of use set out below (‘Terms of use').
Content
Unless indicated otherwise:
- intellectual property rights subsisting in the Item Authoring Tool are owned by Education Services Australia Limited (ESA);
- You may use the Item Authoring Tool only:
- to preview, author and review Test Items;
- to add metadata and resources to Test Items;
- to generate standard reports on Test Items;
- if ACARA has provided You with administrator access, to add and remove users; and
- within the level of access provided to You by ACARA.
- You are not permitted to:
- adapt the Item Authoring Tool for any purposes, whether non-commercial, educational or otherwise;
- share the Password with any person or make it available or accessible, directly or indirectly, intentionally or unintentionally, to any person;
- circumvent any Technological Protection Measure (for example a password) or interfere with any Electronic Rights Management Information.
ESA has created the Item Authoring Tool in good faith and has endeavoured to ensure that it does not breach any entity's rights at the time of its inclusion. However, the Item Authoring Tool may contain unintentional errors and is provided 'as is'.
Limitation of liability
To the maximum extent lawful, ESA:
- excludes all warranties in respect of the Item Authoring Tool; and
- is not liable for:
- any loss or damage however caused resulting from the use of the Item Authoring Tool or the Website; or
- any incidental, special or consequential damages of any nature arising from the use of or inability to use the Item Authoring Tool or the Website.
